EEOC ruling that gender-identity discrimination is sex discrimination

An employer who discriminates against an employee or applicant on the basis of the person’s gender identity is violating the prohibition on sex discrimination contained in Title VII of the Civil Rights Act of 1964, according to an opinion issued on April 20 by the Equal Employment Opportunity Commission (EEOC). The opinion, experts say, could dramatically alter the legal landscape for transgender workers across the nation.

Carolyn Ann Grant’s Hatred Of Women Born Transsexual

Mr. Grant certainly doesn’t hide the fact that he has it in for women born transsexual who actually go through transition.  He has attacked more women on his blog than I can count. I am at around 60 articles or so. Oh, and he said that I am not important to him. Oh, but I must beg to differ. I am a whipping post for your failures in life. In the text below, we see that you consider yourself a transsexual woman who decided not to transition because of money and your wife. And you go on to say it is selfish of us to transition. Is it selfish to do something that might cost you your entire family? When I came out to my twin brother, I was shaking and could barely produce a single word. Because I was about to be faced with the possibility of losing my brother, forever. I adore and cherish my brother in ways that non-twin siblings can’t. I was so horrified by what he might say but I had to do it. I had to do it for my own survival. Luckily, he accepted me with open arms and told me he loved me.

For me, the cost of a transition isn’t worth it, and as such – I won’t. Without fanfare or accolade, It’s basically the fact that I love my wife more than I know, and I’ll not do something that would jeopardize our relationship. I, let alone her, would view such an act as not just selfish, but also rejecting everything we have built, together. I simply won’t do that.

If I were single, I probably would transition, and I’d discover the grass isn’t greener – it’s just the same, really. [I gave this some extra thought - and I don't know if I would, or not.]

To mask your own cowardice, you say we are selfish and would destroy the relationships we have. To me, this is transphobic. It isn’t our fault that you weren’t brave enough to take on what we did. So, what better way to make yourself feel better? Attack transsexual women on an almost daily basis. You hate us because you are jealous. Perhaps there is a lot of self-loathing going on here.

Apple, Oracle, Google Lead Major Vendors with Software Vulnerabilities in Q1, Security Report Says

Apple led all major technology vendors in reported vulnerabilities in its operating system and software during the first three months of 2012, according to a report released Tuesday by Trend Micro.

I have worked in the computer security field for over 7 years and have always been concerned about the false sense of security Apple pushes to die-hard fans.  Back in March, 2006, Brian Krebs, then a security researcher and writer for the Washington Post, wrote a story about the thankless jobs of Botnet researchers (Bringing Botnets Out of the Shadows).  In the article, Krebs talks about the efforts of Shadowserver.org which was founded by my old friend, Nicholas Albright.  I showed Nicholas how I researched botnets and he went on to create one of the most valuable and helpful computer security organizations in existence. I joined them for a short time but quickly burned out and went on to other things.

In the article, Krebs mentioned a botnet that I was working on, which consisted of only Linux and Mac OS X systems. Just the mention of Mac systems being compromised and being part of a botnet sent the Apple fan-base into an uproar. Apple has a fairly arrogant view on security, when it comes to their products. They always pushed a false sense of security to their consumers. Even going as far as to imply their operating system was immune to viruses.

Hello, Flashback Trojan!

The trojan targets a Java vulnerability on Mac OS X. The system is infected after the user is redirected to a compromised bogus site, where JavaScriptcode causes an applet containing an exploit to load.

Oracle, the company that develops Java, fixed the vulnerability exploited to install Flashback on February 14, 2012.[7] However, Apple maintains the Mac OS X version of Java and did not release an update containing the fix until April 3, 2012,[10] after the flaw had already been exploited to install Flashback on 600,000 Macs.

Once the malware is installed, the Trojan steals passwords and banking info from Safari.

Apple’s slow response in addressing a vulnerability that was being actively exploited, put users at risk of having their personal and private data exposed.  Apple released a Java update that fixed the vulnerability and removed the Flashback Trojan on April 3rd, 2012. However, they are not releasing fixes for Mac OS X 10.5 and older. There is a bit of irony here. The version of Mac that was current at the time Krebs published “When Macs Attack“,  which generated all the outrage from the apple fan club, was OS X 10.4, which is now vulnerable to attack until the end of time.

It seems that Apple is far behind Microsoft when it comes to addressing security vulnerabilities. Hopefully they will catch up, soon.

It just makes my heart ache to think that I am responsible for bullying this poor, defenseless lad.  Our constant bullying (an article or two here and there) has caused him great distress. So much distress that he uses demeaning words such as stupid, hollow, boy, moron, prissy, transsexual bigot (not kidding), coward, communist, trivial minnows, angry tranny,  feeble-minded, pathetic, sad sacks, ranting five year old,  and dozens of others, which I guess is just his way of dealing with all the pain we have caused him. The stress this has caused him makes him actually think he doesn’t attack others and doesn’t use offensive words to describe us.

Please stop by and give this poor victim a nice warm hug. Be nice, now!

University of Pittsburgh – Transphobia

Most of the time, when a college or university alters it’s policy when dealing with protections for gender identity, they move forward. However, Pitt took a step back.

Pitt’s Anti-Discriminatory Policies Committee unanimously passed a resolution that would allow students to use bathrooms allocated to the gender they identify with, not their natal sex.  Before Pitt’s new decision, the choice of restroom use was up to the students — they were allowed to use restrooms based on the gender with which they identified.

But at Tuesday’s meeting, an unidentified University representative said that students would be forced to use gendered facilities according to the sex listed on their birth certificates.

So what caused someone at Pitt to do an about-face when it comes to protecting students? Perhaps it had to do with the actions of one Pitt student, who got expelled after he used the men’s locker room, after being told not to do so.

 Jerome Cochran, Pitt’s executive vice chancellor and a member of the Office of General Counsel of the University, previously confirmed that, in November, Johnston was arrested for and charged with indecent exposure, defiant trespass and disorderly conduct after he showered and changed in a men’s locker room on campus. Johnston has since been expelled.

A video posted on Youtube Dec 17, 2011 shows Johnston and his wife confronting campus police. It is a very bizarre video, to say the least. But one thing it does show, Pitt’s security and police are not properly educated when it comes to gender identity. The security person in the white shirt referred to Johnston as female and the dark uniformed officer refers to Johnston’s wife as a male.

Pitt’s transgender policy conflicts with city, county policies

Charles Morrison, the director of the commission that Pittsburgh Mayor Luke Ravenstahl appointed, studies and investigates complaints of alleged discrimination in employment, housing and public accomodations within the city limits. His commission has the power to issue subpoenas to aid investigations and hearings on any policy that discriminates against a person for things such as sex and sexual orientation.

“According to the city code, ‘Sex is the gender of a person, as perceived, presumed or assumed by others, including those who are changing or have changed their gender identification,’” Morrison said. “From what it sounds like, the University is not in accord with [the code].”

Before Pitt’s new decision, the choice of restroom use was up to the students — they were allowed to use restrooms based on the gender with which they identified.

So, did Pitt change the restroom policy to get back at Johnston? Did they decide that getting back at him is more important than the safety of their students? It appears, that way.

When it comes to showers, has Pitt ever thought about following other Universities that install stalls?
